Private motor carrier means a person who provides transportation of property or passengers, by commercial motor vehicle, and is not a for-hire motor carrier.

(1) The rules in this subchapter are applicable to all employers, employees, and commercial motor vehicles that transport property or passengers in interstate commerce.

§ (f) Exceptions. Unless otherwise specifically provided, the rules in this sub chapter do not apply to—

§(3) The occasional transportation of personal property by individuals not nor in the furtherance of a commercial enterprise;

49 CFR Section § 390.9: State and local laws,

Question 1: If an interstate driver gets stopped by a State enforcement officer for an inspection, would the inspecting officer be enforcing the Federal regulations or State regulations?

Guidance: A State enforcement officer can only enforce State laws. However, under the Motor Carrier Safety Assistance Program, quite often State laws are the same as or similar to the FMCSRs.
